The profile he swore was corrected

In 2014 his website carried a profile of the judge presiding over his own custody case, and on it a 1991 Washoe County case listed as that judge's, challenged by two people who wrote to the site in May 2014 on the ground, as his affidavit puts it, that the judge "was not elected at the time." In his sworn affidavit of July 2014 he said the two never identified themselves as campaign staff, never got back to him with the documentation they promised, and that he removed the entry once an attorney explained the docket to him, after the judge's recusal order of July 8 had impugned his credibility. His own exhibits to the affidavit are the emails. On May 21 he wrote that he did not think he would be able to change the entry; on May 22 the reply said the judge had never sat on the case in any capacity and promised documentation. The recusal order says correction was demanded and refused.

The two sides, quoted

"That I can recall two (2) individuals who contacted me through [the website's administrator address] regarding Weller's profile ('The Profile') but that they did not identify themselves as Weller Campaign operatives"; "That we never reached an impasse regarding the issue, but rather, [the two individuals] failed to get back to me regarding the documentation they were going to provide and I assumed the case to be valid"; "That on July 9, 2014, alarmed by the manner in which my credibility was being impugned by Weller's July 7, 2014 Recusal order, I contacted an attorney with experience in the court system who clarified that Department 11 did not exist at the time the #DV91-256 case was appealed ... based on this information, I removed the #DV91-256 case from Weller's Profile"

Affidavit of Alexander M. Falconi, notarized July 14, 2014, filed July 17, 2014, paragraphs 11, 13 and 14, No. FV08-03200 (NSC No. 69341, Record on Appeal Vol. 12, filed May 31, 2016, pp. 175-176) PDF: No. 69341, pp. 174-183

"I don't think I will be able to change that case without a close look at that appealed order to see if another judge's signature is on it."

His email of May 21, 2014 from the ournevadajudges.com administrator address, attached to the same affidavit as his Exhibit 2 (Vol. 12, p. 182) PDF: No. 69341, pp. 174-183

"He was not acting pro tem, by appointment or in any other capacity in Darren Mack v. Debra Lynn Mack, Washoe Case Number DV91-256 I will provide documentation ASAP."

The reply of May 22, 2014, in the same exhibit (Vol. 12, p. 182) PDF: No. 69341, pp. 174-183

campaign staff "responded directly to Mr. Falconi, informed him that his website contained false information, and demanded correction or removal of the false information. Mr. Falconi refused to correct or remove the false information."

Order of Recusal, Judge Weller, July 8, 2014 (NSC No. 69341, Record on Appeal Vol. 12, p. 158) PDF: No. 69341, pp. 156-160
Note. By his own affidavit the entry came down after the recusal order of July 8, 2014: seven weeks after the reply of May 22 that the judge had never sat on the case, and after he had written that he did not think he would be able to change it.
